1. Introduction & Definitions

Welcome to CVGen! These Terms and Conditions ("Terms") govern your use of the CVGen website and services (collectively, the "Service") provided by CVGen ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

Key definitions used in these Terms:

• "Service" refers to the CVGen web application, website (cvgen.co.uk or other domains operated by us), and all related AI-powered CV and cover letter generation tools, features, and content.
• "User," "You," "Your" refers to any individual or entity accessing or using the Service. This includes individual job-seekers and representatives of small businesses using the service for their candidates (where permitted).
• "Input Data" refers to all information, text, documents, and other materials you provide to the Service for the purpose of generating CVs and cover letters, including but not limited to personal details, employment history, skills, and job descriptions.
• "Generated Content" refers to the CVs, cover letters, and any other documents or text created by the Service based on your Input Data.
• "Fee" refers to the applicable price for using the Service to generate and receive documents, as displayed on the Service at the time of purchase.
• "Transaction" refers to the process of submitting Input Data, previewing Generated Content (where applicable), paying the Fee, and receiving the final Generated Content.

2. Scope of Service

CVGen is an online platform that uses artificial intelligence (AI) to assist Users in generating personalised curriculum vitae (CVs) and cover letters. Users provide Input Data, and the Service processes this data to create Generated Content. The Service aims to provide professionally formatted and well-written documents tailored to the User's information and stated goals.

The Service provides a preview of the Generated Content where possible. The final Generated Content is delivered to the User electronically (e.g., via email) upon successful payment of the Fee.

3. Eligibility

To use our Service, you must:

• Be at least 16 years old. If you are under 18, you must have the permission of a parent or legal guardian to use the Service and for them to agree to these Terms on your behalf.
• Have the legal capacity to enter into a binding contract.
• Provide accurate and truthful information as required by the Service.

We do not require users to create a persistent account to use the core generation service. Each document generation is treated as a discrete Transaction. Features like re-requesting documents within a 7-day window are facilitated through email and a unique transaction reference ID.

4. Service Usage, Fees & Payment

• Service Process: To use the Service, you will submit Input Data through our online form. You may be shown a preview of the Generated Content. To receive the final, editable Generated Content, you must pay the then-current Fee.
• Fees: The Fee for the Service will be clearly displayed before you make a payment. All Fees are quoted in GBP (£) and are inclusive of VAT where applicable. We reserve the right to change our Fees at any time, but changes will not affect any Transaction for which you have already paid.
• Payment: Payments are processed through our third-party payment processor, Stripe. By making a payment, you agree to Stripe's terms and conditions. We do not store your full credit or debit card details.
• Delivery: Upon successful payment, the Generated Content (CV and/or cover letter) will be made available to you electronically, typically via email to the address you provided. We aim for instant delivery but do not guarantee against delays caused by technical issues or email provider delays.
• Refunds: Due to the digital nature of the Service and the instant delivery of Generated Content, all sales are final, and we do not offer refunds once a payment has been processed and the generation process has been initiated or completed. If you experience a technical issue preventing you from receiving your Generated Content after payment, please contact us at contact@cvgen.co.uk for assistance.

5. User Obligations

By using the Service, you agree to:

• Provide true, accurate, current, and complete information as Input Data.
• Use the Service and Generated Content for lawful purposes only, primarily for personal job-seeking activities or, if you are a business, for assisting candidates you directly represent (where our Service expressly permits such use).
• Not misuse the Service or its AI capabilities. This includes, but is not limited to:
  • Generating content that is false, misleading, defamatory, obscene, or hateful.
  • Attempting to reverse-engineer, decompile, or otherwise discover the source code or underlying algorithms of the Service.
  • Using the Service to create content that infringes on the intellectual property rights of others.
  • Using automated scripts or bots to access or use the Service in a way that disrupts or places an unreasonable load on our infrastructure.
• Be solely responsible for the review and accuracy of the final Generated Content before its use. While our AI strives for accuracy, it is your responsibility to ensure the Generated Content correctly represents your details and is suitable for your intended purpose.
• Not represent that Generated Content is entirely human-generated if submitting to platforms or entities that prohibit AI-generated content without disclosure.

6. Intellectual Property

• Our Service: We (and our licensors) own all right, title, and interest in and to the Service, including the website, design, software, underlying AI models (as licensed from our providers like OpenAI), and all associated intellectual property rights. These Terms do not grant you any rights to our intellectual property except for the limited license described below.
• Input Data: You retain ownership of the Input Data you provide to the Service. You grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process your Input Data solely for the purpose of providing the Service to you (i.e., generating your documents).
• Generated Content: Upon your successful payment of the Fee, we grant you a worldwide, perpetual, non-exclusive, royalty-free license to use, reproduce, modify, and distribute the specific Generated Content created for you for your personal job-seeking purposes or agreed business purposes. You are free to edit and adapt the Generated Content.
• Restrictions: You may not sell, lease, or sublicense the Generated Content as a standalone product or service to third parties without our express written permission.

7. Disclaimers and Warranties

• "As-Is" Service: The Service is provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the operation, availability, or accuracy of the Service or the Generated Content.
• No Guarantee of Job Offers: We do not guarantee that the use of our Service or Generated Content will result in job interviews, job offers, or any particular career outcome. Job success depends on many factors beyond the scope of our Service.
• Accuracy of Content: While we use advanced AI and strive to produce high-quality, accurate Generated Content, we do not warrant that the Generated Content will be error-free, complete, or perfectly tailored to every User's specific needs or every job application. You are solely responsible for reviewing, verifying, and editing all Generated Content before use.
• AI Limitations: You acknowledge that AI-generated content may sometimes be imperfect, contain inaccuracies, or produce outputs that do not fully meet expectations.

8. Limitation of Liability

To the fullest extent permitted by English law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any Generated Content obtained from the Service; and (iv) unauthorized access, use, or alteration of your Input Data or Generated Content.
• Our total aggregate liability to you for all claims arising out of or relating to the Service or these Terms, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total Fees paid by you to us for the specific Transaction giving rise to the claim.
• Nothing in these Terms shall limit or exclude our liability for:
  • Death or personal injury caused by our negligence;
  • Fraud or fraudulent misrepresentation; or
  • Any other liability that cannot be excluded or limited by English law.

9. Termination

• By You: You may stop using the Service at any time. As there are no ongoing subscriptions or accounts for the core generation service, discontinuing use effectively terminates your engagement for future Transactions.
• By Us: We may suspend or terminate your access to the Service, in whole or in part, at any time and for any reason, without prior notice or liability, including but not limited to if you breach these Terms.
• Effect of Termination: Upon termination, your right to access and use the Service for future Transactions will cease. Data retention is governed by our Privacy Policy; typically, Input Data and Generated Content associated with a Transaction are deleted after 7 days. Termination does not typically entitle you to a refund of Fees already paid, except as may be expressly required by applicable law.

10. Indemnification

You agree to defend, indemnify, and hold harmless CVGen and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to legal fees) arising from:

• Your use of and access to the Service;
• Your violation of any term of these Terms;
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right; or
• Any claim that your Input Data or your use of Generated Content caused damage to a third party.

11. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms or their subject matter or formation.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect, for example, by posting a notice on our website or sending an email to users who have recently transacted (if we have their email for such purposes). What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the website and the Service.
